The recent NAR settlement is bringing significant changes to the real estate industry, raising key questions for agents. How will the adjustments affect new-build transactions under contract before the MLS policy change? Will the offers of compensation for these transactions be altered? Can a listing broker offer compensation on a broker website, and how will this impact our operations? Will the 
Buyer-Broker Agreement be required by all sales agents when showing or touring a home or only by REALTORS®? What are the implications for open houses, and how will these regulations be enforced? What issues are you seeing?

Meet Our Speakers

Benjamin Gottlieb
Benjamin Gottlieb is the founder of Gottlieb Law, PLC. He graduated with high honors from the business program at Michigan State University. Then, he attended the Sandra Day O'Connor School of Law at Arizona State University, where he served as the Managing Editor for the Arizona State Law Journal. Benjamin is an experienced attorney who has handled hundreds of real estate, business, and commercial cases. His 14-plus-year legal career has been highlighted by numerous court victories and successful settlements for his clients in a wide range of commercial litigation and real estate matters. While Benjamin strives to settle cases amicably out of court, if warranted, he is not afraid to take a case to trial and has received several favorable jury verdicts on behalf of clients. He currently holds an undefeated jury trial record, having served as lead attorney in several jury trials. Benjamin has also successfully handled several appeals on behalf of clients at the Arizona Court of Appeals, receiving favorable opinions from his clients, several of which have resulted in published opinions.  Benjamin also has considerable experience representing and assisting clients in commercial real estate transactions.

Tiffany Jones
As a licensed Associate Broker with over 15 years of experience, I have successfully mentored new agents for ten years and held the position of Managing Broker at two Phoenix brokerages with 200-3,000 agents. I currently work with a high-producing team in the Phoenix and Prescott markets. In my previous role as a Managing Broker, I oversaw deal negotiations, ensured compliance, and guided agents through complex transactions. My expertise in market trends and transaction management allows me to deliver exceptional results for both clients and agents.

Michael Orcutt
Michael Orcutt represents licensed professionals in courts across Arizona and before regulatory and administrative bodies, such as the Department of Real Estate, the Department of Insurance and Financial Institutions, and the Arizona Association of REALTORS®. His practice includes the defense of real estate agents and brokers, architects and engineers, law firms, insurance brokers, appraisers, and other professionals through all stages of litigation, from pre-suit mediation to appeals before the Arizona Court of Appeals and the U.S. Court of Appeals for the Ninth Circuit. As part of this practice, Michael has obtained complete defense verdicts for licensed professionals in more than one dozen bench and jury trials in Maricopa, Pima, Coconino, and Yavapai Counties.

Roger Nelson
Roger Nelson, a respected figure in the real estate community, has been the Chief Executive Officer of the West & Southeast REALTORS® of the Valley, Inc. (WeSERV) for 20 years. WeSERV, a not-for-profit corporation, operates as an association that serves REALTORS® and advocates to enhance and preserve private property rights. Under Roger's leadership, the association has grown to a membership of over 25,000 and employs over 30 staff members in Chandler, Peoria, Casa Grande, Sierra Vista, and Rio Rico, Arizona. Roger's values are evident in his involvement with other community non-profits benefiting children in the West Valley, the Executive Committee and Board of Directors for the Arizona Association of REALTORS®, and committees for the National Association of REALTORS®. He has also served as President of the Alumni Association of the Arizona State University School of Global Management. In 2022, his commitment to these values was recognized when he was awarded the prestigious title of "Association Executive of the Year" by the Arizona Society of Association Executives. Born and raised in Arizona, Roger resides in Peoria with his wife, Marideth, and their three dogs, Gigi, Rubi, and Hrothgar. Roger's favorite quote, an ancient proverb, reflects his personal values: "A society grows great when old men plant trees under whose shade they know they'll never sit." Although he doesn't consider himself an old man, he does try to live by planting trees daily among those he touches.
